Terms of Service

By accessing or using the Funnelyn platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and PT Funnelyn Teknologi Indonesia ("Funnelyn", "we", "us", or "our").

To use the Service, you must create an account by providing accurate, current, and complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activity that occurs under your account.
• Notifying us immediately of any unauthorized use of your account at security@funnelyn.io.

You must be at least 18 years of age to create an account. We reserve the right to refuse registration or cancel accounts at our discretion.

Funnelyn offers multiple subscription tiers:

Starter Plan: Access to basic lead search and enrichment features up to the plan's contact limit. Billed monthly or annually.

Growth Plan: Expanded contact limits, intent data signals, and API access. Billed monthly or annually.

Professional Plan: Unlimited contacts, advanced enrichment, DSP integrations, dedicated support, and custom workflows.

Enterprise Plan: Custom pricing, SLAs, SSO, custom data agreements, and dedicated account management.

Plan details, limits, and pricing are available at funnelyn.io/pricing. We reserve the right to change pricing with 30 days' notice.

Subscriptions are billed in advance on a monthly or annual basis. By providing payment information, you authorize us to charge the applicable fees.

Late payments: Accounts with overdue balances may be suspended after 7 days and terminated after 30 days.

Refunds: Annual subscriptions include a 14-day money-back guarantee. Monthly subscriptions are non-refundable except where required by law.

Taxes: Prices exclude applicable taxes. You are responsible for all taxes associated with your purchase, except for taxes on our net income.

Currency: All charges are in US Dollars (USD) unless otherwise specified at checkout.

You agree to use the Service only for lawful purposes. You may not:

• Use the Service to send unsolicited bulk email or messages (spam).
• Use the Service to violate any individual's privacy rights or data protection laws.
• Attempt to reverse-engineer, decompile, or extract source code from the Service.
• Use automated scraping tools against our platform beyond the provided API.
• Impersonate any person or entity or misrepresent your affiliation.
• Use the Service to store or transmit malicious code.
• Exceed rate limits or abuse our API infrastructure.

Violation of these terms may result in immediate account suspension without refund.

Contact data accessed through the Funnelyn platform is licensed, not sold. Your use of lead data is subject to the following restrictions:

• Data may only be used for legitimate B2B sales and marketing outreach.
• You must comply with all applicable anti-spam laws, including CAN-SPAM, CASL, Indonesia's Electronic Information and Transactions Law (UU ITE), and GDPR where applicable.
• You may not resell, sublicense, or provide bulk access to lead data to third parties.
• You must honor opt-out requests and maintain suppression lists.
• Data exported from the platform may not be used after your subscription ends.

We reserve the right to audit your use of lead data and terminate your account for violations.

The Service and its underlying technology, content, and data compilations are owned by Funnelyn and its licensors, protected by copyright, trademark, and other intellectual property laws.

You retain ownership of any data you upload to the platform. By uploading data, you grant Funnelyn a limited license to process that data solely to provide the Service.

The Funnelyn name, logo, and product names are trademarks of PT Funnelyn Teknologi Indonesia. You may not use these marks without prior written permission.

To the maximum extent permitted by applicable law:

Disclaimer of warranties: The Service is provided "as is" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

Limitation of damages: In no event shall Funnelyn be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or data, arising from your use of the Service.

Cap on liability: Funnelyn's total liability to you for any claims arising under these Terms shall not exceed the amounts paid by you to Funnelyn in the 12 months preceding the claim.

Either party may terminate this agreement at any time:

By you: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.

By us: We may suspend or terminate your account immediately for violation of these Terms, non-payment, or conduct we determine is harmful to the Service or other users. We will provide notice where practicable.

Upon termination, your right to access the Service ends immediately. You may request a data export within 30 days of termination. After 30 days, your data may be deleted.

These Terms shall be governed by and construed in accordance with the laws of the Republic of Indonesia, without regard to its conflict of law provisions.

For users located in the European Union, nothing in these Terms affects your rights under EU consumer protection laws, which cannot be excluded by contract.

In the event of a dispute arising under these Terms, the parties agree to first attempt to resolve the dispute informally by contacting legal@funnelyn.io.

If informal resolution fails within 30 days, disputes shall be submitted to binding arbitration in Jakarta, Indonesia under the rules of the Badan Arbitrase Nasional Indonesia (BANI). Arbitration shall be conducted in English.

Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

We may modify these Terms from time to time. For material changes, we will provide at least 30 days' notice via email or a prominent notice in the Service before the changes take effect.

Your continued use of the Service after the effective date of modified Terms constitutes your acceptance of the changes. If you do not agree to the new Terms, you must stop using the Service.
